EnCirca Supporting All New Sunrise Periods, But Please Wait

EnCirca is supporting over 20 Sunrise Periods this month, including .guru, .clothing and even the arabic TLD .shabaka. But please wait until December 14 before submitting any more applications. This is because none of the SMD files issued by the TMCH before this date will be valid.

EnCirca is supporting all of the new Sunrise Periods, including .guru, .clothing and even the arabic shabaka. We expect there will be nearly 30 Sunrise Periods underway during the month of December. But please wait until December 14 before submitting any more Sunrise applications to EnCirca. Sunrise applications already submitted may need to be re-submitted after December 14 with a newly-issued SMD file from the Trademark Clearinghouse, depending on how a specific Registry has implemented their Sunrise.

As reported here last Friday, the TMCH is revoking all of the SMD files that have been issued since it opened. Therefore, any Sunrise application submitted using a SMD file issued before December 14 will appear on the revocation list checked by Registries for their Sunrise Period.

Since all of the current Sunrise periods are allocating names at the end of their Sunrise period, this means that all of the SMD files that have been issued by the TMCH through December 13 will not be valid for any new Sunrise Period following December 14, even if it has already been used to submit a Sunrise application to a Registry.

[Update] Sunrise applications and DPML blocks already received by the Donuts’ Registries will remain valid and do not need to be re-submitted.

ICANN Registrars are required to check whether the SMD file is on the revocation list. So, trademark owners should blocked by their Registrar from submitting a revoked SMD file by mistake after December 14.

There are over 16,000 records in the TMCH today. Trademark owners or their agents have downloaded the corresponding SMD file for some fraction of these. These should all be discarded. A smaller fraction of SMD files have been provided to ICANN Registrars. These should all be discarded. A even smaller fraction have been submitted to a TLD registry for Sunrise. These may need to be re-submitted with a valid SMD file after December 14, depending on the Registry.

The Trademark Clearinghouse (TMCH) announced today a mass revocation of SMD files will occur on December 14.
This means that the submission of Sunrise applications should be deferred until the new SMD files are available. See the full list of Sunrise periods underway at EnCirca.

This means that the submission of Sunrise applications should likely be deferred until December 14.

Newly-issued SMD files can be retrieved by trademark owners AFTER December 14 via their TMCH account. Of course, trademark owners should therefore wait until after December 14 before providing their ICANN Registrar a SMD file for Sunrise registrations, to ensure the correct SMD file is uploaded to the Registry for various Sunrises.

Any Sunrise application already submitted to a gTLD Registry, may need to be re-submitted after December 14. This would occur if a Registry decided to re-check the validity of SMD files prior to the allocation of the domain name. A SMD file issued before December 14 would then appear on the revocation list, resulting in a rejection.

This change could have the practical effect of shortening the 60 day Sunrise Periods for Sunrises that have already started, or will begin before December 14. However, Registries may elect to extend the deadline.
